Govt mulls stopping Asia Energy’s activities in country

The government is likely to stop activities of Asia Energy Corporation, who have proposed to extract coal from the Phulbari deposit in Dinajpur through the controversial open-pit method, as it has no valid contract with the relevant authority in the country.
‘Officials of Asia Energy often visit Phulbari, although the company does not have any valid stake in Bangladesh. Their visit to Phulbari causes unrest in the area, which is not acceptable,’ energy division secretary Abu Bakar Siddique told New Age.
‘We are now scrutinising the legal aspects of the company’s existence in Bangladesh,’ he said.
When asked why the Bureau of Mineral Department had been receiving license renewal fees from Asia Energy, the secretary said the ministry had removed a director of the BMD for not taking proper action on the matter.
He said policymakers, including the state minister for power, energy and mineral resources minister Nasrul Hamid, were aware of the matter.
‘The company had a license to conduct feasibility study which was done much earlier. Now they should not stay here,’ he said.
People against open-pit mining at Phulbari coal deposit on November 26, 2014 staged demonstration and put a blockade on the highway protesting a campaign programme there by the AEC’s head Gary Lye.
Local law enforcers had to protect Gary and his wife from the wrath of local people, officials said.
The Phulbari people also staged protest programmes when Gary tried to distribute blankets among poor people one year back.
On August 26, 2006, members of Bangladesh Rifles shot dead three local people — Salekin, Tariqul, and Amin — in a peaceful demonstration against the proposed open-pit mining project.
Locals, environmental activists and a portion of experts protested at the project saying it would destroy a vast area’s water table, environment and habitats. The project was later postponed.
When asked, an energy division official said that Gary’s visit to Phulbari might be aimed at making a display of AEC stake in the coal deposit to the shareholders of the company’s parent organisation Global Coal Management PLC.
GCM will hold its annual general meeting on Tuesday in London.
The AEC’s license for feasibility study to develop Phulbari coal mine, using open-pit method, expired on January 27, 2006, but its parent organisation continued advertising its stake in the Phulbari coal deposit.
Locals and rights activists, including the national committee to protect oil, gas, mineral resources, power and port, have been demanding shutting down of AEC’s operation in Bangladesh, since 2005.
AEC is now running two offices, one at Phulbari and the other in Dhaka, with 25-30 officers and staff members. Besides, over a hundred community liaison assistants are engaged in Phulbari to campaign in favour of the project, company officials said.
When asked, Gary said AEC had ‘two exploration licenses and a mining lease covering the Phulbari coal deposit.’
‘In addition, we have a contract with the government of Bangladesh for ‘exploration and mining of coal in northern Bangladesh,’ he said.
Gary also said, ‘We have been operating in Bangladesh since February 1998 when our contract 11/C-94 was assigned to us from BHP by the first Awami League government with Tawfiq-e-Elahi Chowdhury as the energy secretary.’
He said that the company maintains a bank account following the conventional rules of Bangladesh and also comply with the requirements set out by the Board of Investment, Bangladesh Bank and the National Board of Revenue.

PROTESTERS outside the London Stock Exchange (LSE) have demanded that British mining company GCM Resources (GCM) is delisted for what they called “criminal and fraudulent activities.”
The Phulbari Solidarity Group said today that GCM should be held to account over the shooting of three Bangladeshi teenage boys at a protest 13 years ago over plans for a coal mine.
Today the demonstrators attempted to enter the LSE headquarters to urge its chief financial officer David Warren to delist the firm over the shooting. They also cited the alleged sale of shares in the project, which has yet to start, as cause for delisting.
But they were stopped as scores of police blocked entrances to the building.
A coalition of 12 organisations asked the LSE to investigate and delist GCM over the allegations that they detailed in a letter.
The three teenagers — between the ages of 12 and 19 — were shot dead and 200 more injured at a protest of 80,000 people in Phulbari, Bangladesh, against a proposed open pit mine there.
They had rallied against the plans by GCM subsidiary Asia Energy, which campaigners fear will displace 130,000 people.
Construction is dependent on approval from the Bangladeshi government which had previously shelved the plans following protests.
GCM’s CEO Gary Lye has filed multiple cases against 26 community organisers in Phulbari and Dinajpur, claiming he has felt “harassed” when he visited the area in an attempt to continue his mining plans in 2014.
Nuruz Zaman, a survivor of the Phulbari shooting and a local community organiser, accused GCM of fraud — and raised concerns that the company was selling shares in the project even though it hasn’t yet started.

যুক্তরাজ্যভিত্তিক কোম্পানি গ্লোবাল কোল ম্যানেজমেন্টের (জিসিএম বা সাবেক এশিয়া এনার্জি) সঙ্গে বাংলাদেশ সরকারের এখন কোনো চুক্তি নেই। এরপরও দিনাজপুরের ফুলবাড়ী কয়লাখনি থেকে কয়লা উত্তোলন এবং তা দিয়ে বিদ্যুৎ উৎপাদন করা হবে—এমন দাবি করে যুক্তরাজ্যের লন্ডন স্টক এক্সচেঞ্জে (এলএসই) শেয়ার ব্যবসা করছে কোম্পানিটি। এ ঘটনায় বাংলাদেশ সরকার আইনি ব্যবস্থা নেওয়ার কথা ভাবছে।
এ বিষয়ে বিদ্যুৎ, জ্বালানি ও খনিজ সম্পদ প্রতিমন্ত্রী নসরুল হামিদ প্রথম আলোকে বলেন, চুক্তি না থাকার পরও ফুলবাড়ী কয়লাখনি থেকে কয়লা উত্তোলন করবে—এমন অসত্য তথ্য দিয়ে লন্ডনে শেয়ার ব্যবসা করছে জিসিএম বা এশিয়া এনার্জি। বিষয়টি সরকারের নজরে এসেছে। তাদের বিরুদ্ধে আইনি ব্যবস্থা নেওয়ার পথে এগোচ্ছে সরকার।
নসরুল হামিদ বলেন, প্রধানমন্ত্রী শেখ হাসিনার পরিষ্কার নির্দেশনা রয়েছে, ফুলবাড়ী থেকে এখন কয়লা উত্তোলনের কোনো পরিকল্পনা সরকারের নেই। ফুলবাড়ীর কয়লা ভবিষ্যতের জন্য মজুত রেখে দেওয়া হয়েছে। যদি ভবিষ্যতে উন্নত কোনো প্রযুক্তি আসে, যার মাধ্যমে পরিবেশের ক্ষতি হবে না, তখন কয়লা উত্তোলনের বিষয়টি নিয়ে ভাবা যাবে।
মন্ত্রণালয় সূত্র জানায়, দিনাজপুরের ফুলবাড়ী কয়লাখনি নিয়ে একটি সমীক্ষা ও কর্মপরিকল্পনার (কয়লা উত্তোলন) জন্য ২০০৪ সালের ২৮ জানুয়ারি জ্বালানি বিভাগের প্রতিষ্ঠান খনিজ সম্পদ উন্নয়ন ব্যুরোর (বিএমডি) কাছ থেকে দুই বছরের অনুমোদন (লাইসেন্স) পায় এশিয়া এনার্জি। ওই অনুমোদনের মেয়াদ ২০০৬ সালের ২৭ জানুয়ারি শেষ হয়ে গেছে। এরপর এশিয়া এনার্জির লাইসেন্স আর নবায়ন করেনি বিএমডি। তাই আইনত ফুলবাড়ী কয়লাখনির উন্নয়নে কোনো ভূমিকা রাখার সুযোগ নেই যুক্তরাজ্যভিত্তিক এই কোম্পানির।
২০০৪ সালে অনুমোদন পাওয়ার পর উন্মুক্ত খনন পদ্ধতিতে ফুলবাড়ীতে কয়লা উত্তোলনের চেষ্টা করে এশিয়া এনার্জি। প্রতিষ্ঠানটিকে তৎকালীন বিএনপি-জামায়াত জোট সরকার ৯২ শতাংশ মালিকানা দিয়ে কয়লা উত্তোলনের অনুমতি দিয়েছিল বলে জানান জ্বালানি বিভাগের কর্মকর্তারা।
উন্মুক্ত পদ্ধতিতে কয়লা উত্তোলনের ও কয়লা রপ্তানির বিরোধিতা করে তেল-গ্যাস-খনিজ সম্পদ ও বিদ্যুৎ-বন্দর রক্ষা জাতীয় কমিটি তখন এশিয়া এনার্জির বিরুদ্ধে আন্দোলন শুরু করে। এই আন্দোলনের একপর্যায়ে ২০০৬ সালের ২৬ আগস্ট ফুলবাড়ীতে খনি এলাকায় সমাবেশ ডাকা হয়। সমাবেশে তৎকালীন বিডিআরের (বর্তমানে বিজিবি) গুলিতে স্থানীয় তিন ব্যক্তি নিহত হন, আহত হন দুই শতাধিক। পরে পরিস্থিতি সামাল দিতে সরকার তেল-গ্যাস কমিটির সঙ্গে চুক্তি করে। এই চুক্তির অন্যতম শর্ত ছিল এশিয়া এনার্জিকে দেশ থেকে বহিষ্কার ও তাদের বিচার, উন্মুক্ত খনন পদ্ধতিতে কয়লা উত্তোলন না করা।
যুক্তরাজ্যের লন্ডন স্টক এক্সচেঞ্জের সামনে এশিয়া এনার্জির (জিসিএম) বিরুদ্ধে বিক্ষোভ।
বাংলাদেশে সম্পদ দেখিয়ে যুক্তরাজ্যে ব্যবসা
জ্বালানি বিভাগের কর্মকর্তারা জানান,লন্ডন স্টক এক্সচেঞ্জের সহযোগী হিসেবে কাজ করা অল্টারনেটিভ ইনভেস্টমেন্ট মার্কেটে (এআইএম) ২০০৪ সালে তালিকাভুক্ত হয় এশিয়া এনার্জি। অবশ্য তখন কোম্পানির নাম পাল্টে রাখা হয় জিসিএম। ভবিষ্যতে সম্ভাবনা রয়েছে—এমন ধরনের ব্যবসার জন্য বিভিন্ন কোম্পানিকে শেয়ারবাজার থেকে বিনিয়োগ সংগ্রহের সুযোগ করে দেয় এআইএম।
কিন্তু ২০০৬ সালের পর বাংলাদেশের সঙ্গে এশিয়া এনার্জির কোনো চুক্তি না থাকার পরও লন্ডন স্টক এক্সচেঞ্জে কোম্পানিটি তার সম্পদের মধ্যে ফুলবাড়ী কয়লাখনির তথ্য তুলে ধরছে। এর মধ্যে চলতি বছরের ১৭ জানুয়ারি ফুলবাড়ী কয়লাখনির মুখে বিদ্যুৎকেন্দ্র নির্মাণের জন্য চীনের প্রতিষ্ঠান পাওয়ার চায়নার সঙ্গে চুক্তি সই করেছে এশিয়া এনার্জি। কয়েক বছর ধরে লন্ডনের শেয়ারবাজারে এশিয়া এনার্জির শেয়ারের মূল্য নিম্নমুখী ছিল। চীনের কোম্পানির চুক্তি সইয়ের পর প্রতিষ্ঠানটির প্রতিটি শেয়ারের মূল্য দাঁড়িয়েছে ২৩ দশমিক ৭৫ পেন্স (১০০ পেন্সে ১ ব্রিটিশ পাউন্ড)।
ফুলবাড়ী কয়লাখনির মুখে বিদ্যুৎকেন্দ্র নির্মাণের জন্য চীনের প্রতিষ্ঠানের সঙ্গে এশিয়া এনার্জির চুক্তির বিষয়ে কিছু জানে না বিদ্যুৎ মন্ত্রণালয়। বিষয়টি গুরুত্বসহকারে খতিয়ে দেখা হবে বলে জানান বিদ্যুৎ, জ্বালানি ও খনিজ সম্পদ প্রতিমন্ত্রী নসরুল হামিদ।
এশিয়া এনার্জির সঙ্গে বাংলাদেশের কোনো চুক্তি না থাকার পরও কীভাবে তারা ফুলবাড়ী কয়লাখনি থেকে কয়লা উত্তোলন করবে—এমন দাবি করছে, তা জানতে কোম্পানির মিডিয়া অ্যান্ড কমিউনিকেশন স্পেশালিস্ট মাহমুদ হাফিজের সঙ্গে মুঠোফোনে যোগাযোগ করে প্রথম আলো। তিনি প্রথম আলোকে বলেন, ‘এ বিষয়ে আমি কথা বলার জন্য উপযুক্ত ব্যক্তি নই।’
এদিকে পরিবেশবাদী ও অধিকারভিত্তিক ১২টি সংগঠন গত ১৯ জুলাই লন্ডন স্টক এক্সচেঞ্জের প্রধান আর্থিক কর্মকর্তা ডেভিড পি ওয়ারেনকে চিঠি দিয়ে জিসিএমের শেয়ার ব্যবসা বন্ধের অনুরোধ জানিয়েছে। একই দাবিতে গতকাল শুক্রবার বাংলাদেশ সময় সন্ধ্যায় লন্ডন স্টক এক্সচেঞ্জ কার্যালয়ের সামনে বিক্ষোভ করেছেন পরিবেশবাদী ১২টি সংগঠনের কর্মীরা। এসব সংগঠনের মধ্যে রয়েছে ফুলবাড়ী সলিডারিটি গ্রুপ, তেল-গ্যাস-খনিজ সম্পদ ও বিদ্যুৎ-বন্দর রক্ষা জাতীয় কমিটির যুক্তরাজ্য শাখা, যুক্তরাজ্যের এক্সটিংশন রিবেলিয়ান, যুক্তরাষ্ট্রের ম্যানগ্রোভ অ্যাকশন ফরেস্ট, ব্যাংক ট্রাকসহ ১২টি সংগঠন।
সার্বিক বিষয়ে তেল-গ্যাস-খনিজ সম্পদ ও বিদ্যুৎ-বন্দর রক্ষা জাতীয় কমিটির সদস্যসচিব আনু মুহাম্মদ প্রথম আলোকে বলেন, প্রকাশ্যে চীনা কোম্পানির সঙ্গে এশিয়া এনার্জি খনি এলাকায় বিদ্যুৎকেন্দ্র নির্মাণের চুক্তি করছে, অথচ সরকার জানে না, এটি কোনোভাবেই মেনে নেওয়া যায় না। এই কোম্পানির বেআইনি তৎপরতা বন্ধ করা দরকার। আসলে প্রভাবশালী একটি গোষ্ঠী এশিয়া এনার্জির কাছ থেকে অর্থ পায়, যে কারণে তাদের বিরুদ্ধে সরকার ব্যবস্থা নিচ্ছে না।

The National Committee to Protect Oil, Gas, Mineral Resources, Power and Ports member secretary Anu Muhammad Monday threatened fresh movement if the Phubari agreement signed between the committee and the government was not implemented fully.
He said that the government implemented part of the agreement and was under legal binding to implement it fully.
He was speaking at a rally organised at Nimtola intersection of Phulbari in observance of the 13th anniversary of Phulbari Tragedy Day in the morning.
Anu Muhammad, also an economist, said that the government had had enough time for implementing the agreement since the agreement was signed 13 years ago.
He said that Phulbari movement was an uprising through which people rejected politicians that had favoured foreign companies going against the interest of the people.
The commemorative rally was also attended by Ganosamhati Andolan convener Zonayed Saki and Jatiya Gano Front convener Tipu Biswas, among others.
The rally was held after placing wreaths at the monument erected in memory of those who laid down their lives to prevent open-pit coal mining by Asia Energy on August 26, 2006.
Three demonstrators — Amin, Salaken and Tarequl — were shot dead and hundreds of people were injured when Bangladesh Rifles (now Border Guard Bangladesh) personnel opened fire to disperse the protesters.
After four days of agitation, then Rajshahi city mayor Mizanur Rahman, on behalf of the BNP-led government, signed a 6-point agreement with the protesters led by the national committee.
The government agreed to cancel Asia Energy’s work permit in Bangladesh, scrap plans for open-pit mining, compensate the victims of BDR firing and withdraw complaints lodged against the Phulbari protesters.
Then leader of the opposition Sheikh Hasina, now prime minister, extending her support to the protesters, had vowed that she would implement the agreement if she went to power.
The injured, however, were yet to receive due compensations while the government did not scrap its plan for open-pit mining at the Barapukuria coal field, which was a violation of the pact, alleged local leaders of the national committee.
The Revolutionary Workers Party also observed the day by placing wreaths at Central Shaheed Minar in the capital.
A press release sent by the party said that a discussion was also held on the Shaheed Minar premises.
Speakers at the discussion said that Asia Energy was still conspiring to realise their dream under a different name.
They vowed to resist any effort to start open-pit coal mining in Phulbari.
Communist Party of Bangladesh leaders Mohammad Shah Alam, Ruhin Hossain Prince, Socialist Party of Bangladesh leader Razequzzaman Ratan, and Revolutionary Workers Party general secretary Saiful Huq attended the programme at the Central Shaheed Minar.
